item.index = TextureFactory.LoadTexture(path,key, 256, 256, MTV3D65.CONST_TV_COLORKEY.TV_COLORKEY_USE_ALPHA_CHANNEL)

Dim count As Int32 = TV3DUtility.TextureFactory.GetTextureRefCount(item.index)

The value of count will still = 0 after this texture using alpha channel is loaded. And it is in fact successfully loaded and renders fine. Just not reference counted.
